He died in the custody of an officer performing a borderline restraint for an extremely long time for what that restraint is supposed to be used for.
In my book thatās a strong case for manslaughter or negligent homicide in the US.
Only if that caused him to die. If his heart gave out as he was in excited delirium, then itās not the officer that killed him no matter how bad his actions were.
I donāt see the prosecution have put that entirely to bed, given they have had to call in extra people to discount the conclusions of the original doctor. The problem of ambiguity in the medical evidence has little to do with your distaste at his choice of force.
Iām intrigued with this one as i would be very uneasy of a conviction if this was in the local crown court any given week.
There still has to be a causal link. Itās not as simple as the eggshell test as you still need some form of intent and direct link between that and the death.
I did go to law school after a law degree! Iām not just making this all up. I have seen a lot of criminal trials as well, and itās always about removing any lingering doubt.
An example is a murder scene where you have one fingerprint you canāt identify: the defence say that ācouldā be the murderer.
The point here is there is a string of posts about why his is guilty, but none examining the reasons why there may be doubt. The former is academic if there is the presence of the latter.

I find it interesting that some kinds of kneeling really irritate a lot of people while other forms of kneeling are simply āreasonableā and just doing your job.
