He died in the custody of an officer performing a borderline restraint for an extremely long time for what that restraint is supposed to be used for.

In my book that’s a strong case for manslaughter or negligent homicide in the US.

Only if that caused him to die. If his heart gave out as he was in excited delirium, then it’s not the officer that killed him no matter how bad his actions were.

I don’t see the prosecution have put that entirely to bed, given they have had to call in extra people to discount the conclusions of the original doctor. The problem of ambiguity in the medical evidence has little to do with your distaste at his choice of force.

I’m intrigued with this one as i would be very uneasy of a conviction if this was in the local crown court any given week.

There still has to be a causal link. It’s not as simple as the eggshell test as you still need some form of intent and direct link between that and the death.

I did go to law school after a law degree! I’m not just making this all up. I have seen a lot of criminal trials as well, and it’s always about removing any lingering doubt.
An example is a murder scene where you have one fingerprint you can’t identify: the defence say that ā€œcouldā€ be the murderer.

The point here is there is a string of posts about why his is guilty, but none examining the reasons why there may be doubt. The former is academic if there is the presence of the latter.

I reckon that someone kneeling on my neck would get me into an excited delirium.

I find it interesting that some kinds of kneeling really irritate a lot of people while other forms of kneeling are simply ā€˜reasonable’ and just doing your job.
